If it's yours, if you claim it at any point in it's use, then it's not an orphan and it comes under the current 'fair use' laws.
Orphan works are when you truly research the artist and can't find them. (e.g. old camp pictures with no names or notes on the back).
Asking my mother-in-law 'who made this quilt' and getting 'I don't know, maybe my aunt Lettie who died in 1913' does not count as research.
